A man was set to be arraigned Tuesday in connection with a robbery Thursday at a store in San Francisco’s North Beach neighborhood that resulted in the death of an 85-year-old man.
The arraignment for 31-year-old Garret Miller, however, was continued to Thursday as Miller remains in the hospital, after being placed there for a psychiatric hold, according to prosecutors.
Judge Braden Woods ordered that Miller be held without bail.
Miller will be represented by the Public Defender’s Office.
He’s being charged with murder, robbery, battery, assault and elder abuse for the alleged robbery, which occurred around 4:10 p.m. near a store around the area of Columbus Avenue and Lombard Street.
As Miller was allegedly running from the store, he knocked the victim to the ground. The victim was injured and taken to a hospital, where he died Sunday, police said.
The city’s medical examiner’s office has identified the victim as Sami Batshoun of San Francisco.
Miller was taken into custody Thursday, initially on suspicion of elder abuse and robbery, according to police.
Police spokesman Officer Robert Rueca said on Monday that although Miller may have not intended to commit murder, a murder charge is likely because Batshoun’s death happened during an alleged crime.
