San Francisco City Attorney Dennis Herrera sued the owners of an alleged gambling establishment in the Outer Mission District Monday, seeking a court order to shut it down.
The facility at 4182 Mission Street near Silver Avenue is known as the “Silver Shack” and the lawsuit alleges:
“[The facility] has been operating as an illegal gambling establishment since at least January of 2014.”
The facility has also been called “JHEC of All Trades.” A week after a police raid on Nov. 29, 2016, the business name of the enterprise was changed to “Leisure Time” and the facility reopened as a gambling establishment a few months later, the lawsuit says.
The defendants in the case are property owner Eduardo Bato and operators and managers Angelica Bato, Malcolm Vasquez, Keith Gurriere and Orlando Leonar.
The lawsuit alleges the ground-floor commercial unit occupied by the business is equipped with slot machines and computerized gaming devices.
In addition to the 2016 police raid, the facility was subject to a second police search in October 2017 and received an order of abatement of gambling and unsafe conditions from the city Department of Building Inspection in November, according to the city attorney.
The lawsuit is based on claims of violations of state and city laws that forbid gambling for money on slot machines and gaming devices, as well as a claim of public nuisance created by unsafe conditions and failure to terminate the gambling.
It asks for civil fines and an injunction closing the facility for a year, or, alternatively, payment of the equivalent of a year’s rent on the commercial unit.
Herrera said in a statement:
“This gambling den is like a weed. It’s been cut down before. Now we’re pulling it out by its roots to ensure it doesn’t come back.”
The facility operators could not be reached for comment.
