A federal appeals court in San Francisco on Wednesday refused to allow the Trump administration of President Donald Trump to begin spending $2.5 billion in diverted military funds on border wall construction. A panel of the 9th U.S. Court of Appeals by a 2-1 vote turned down a government request for a stay of a permanent injunction issued by U.S. District Judge Haywood Gilliam of Oakland on June 28. The court acted in a lawsuit filed by the Sierra Club and a coalition of southern border communities.
In a statement, American Civil Liberties Union attorney Dror Ladin said:
“Congress and now two courts have said no to border wall funds.”
Sierra Club attorney Gloria Smith said:
“Today’s 9th Circuit ruling upholds the basic notion that only Congress can appropriate funds.”
