Allegedly armed man shot by Sunnyvale police identified

A man fatally shot by officers while allegedly armed with a knife Thursday afternoon in Sunnyvale was identified Friday as 42-year-old Moises Nerio, a department of public safety spokesman said.

The three officers who shot Nerio have not been identified. They were placed on administrative leave, which is routine protocol in an officer-involved shooting, public safety Capt. Jeff Hunter said.

The officers tried to contact Nerio at his apartment in the 1200 block of Ayala Drive around 12:15 p.m. Thursday, Hunter said.

His half sister had called police to report a sexual assault that had just occurred at their home, according to Hunter.

Nerio allegedly confronted the three officers with a knife and charged at them, Hunter said.

In response, the officers shot at Nerio at close range, according to Hunter.

Nerio was taken to a hospital where he was pronounced dead, Hunter said.

The officers were not injured, the spokesman said.

The department and Santa Clara County District Attorney’s Office is investigating the case.

Anyone with information on the incident is asked to call the department of public safety at (408) 730-7101.
