49ers’ Aldon Smith hit with felony gun charges

There’s more bad news out of Santa Clara for troubled 49ers linebacker Aldon Smith.

The 24-year-old — out indefinitely while receiving treatment for substance abuse following his second DUI arrest — will face three felony weapons charges according to NBC Bay Area.

The 49ers issued a statement concerning today’s report:

“The 49ers organization is aware of the recent developments with Aldon arising from an incident at his home in 2012.  We recognize the serious nature of this situation, as does Aldon, and will continue to monitor it closely.  As this is an ongoing legal matter, we will have no further comment.”

Wednesday’s charges stem from the out-of-control house party Smith hosted at his home in June 2012 that left two guests shot and the All-Pro with stab wounds.

At the scene authorities, found Smith in possession of three assault weapons he purchased in Arizona that were not in compliance with California gun laws.

The two victims have filed a civil suits holding Smith and current Titans tight end Delanie Walker responsible for their wounds as the then-teammates fired shots to end the party, thus instigating the subsequent shooting.

The plaintiffs to do not claim to have been shot by either player.

Immediately after the 49er’s loss to the Colts on Sept. 22, Smith entered a rehab program and apologized for his actions:

“I will do everything in my power to make sure this never happens again. I also want to let everyone know that I’m sorry.”

Head coach Jim Harbaugh has been in touch with Smith via text messages over the past two weeks and reported on his progress at Monday’s press conference:

“Things are going well, very positive.”

Meanwhile rookie Corey Lemonier and veteran Dan Skuta have filled the void left by Smith whose troubles mirror those of ex-49er pass rusher Tim Harris who also wore No. 99 during his last stint with San Francisco.

Prior to the 49ers route of the Houston Texans on Sunday night, Smith wished his teammates well via Twitter:

“Let’s go tonight fellas! #Niners”

There is no time table for Smith’s return, but today’s charges will have major implications for him upon his completion of rehab.
